CC & R’s and Forms

Our Neighborhood has covenants, conditions & restrictions (CC&R’s). We each signed these CC&R’s when we purchased our home. We each pay annual dues to help maintain our common areas and ensure that the CC&R’s are followed by all homeowners. We have three development phases within our neighborhood.

CC&R’s are a set of legal documents that outline the expectations of our neighborhood. They are designed to help maintain our property values and quality of life within our neighborhood.

Common Violations

Wrought Iron Entrance Fences, Special Lot Restrictions
Grantor will construct wrought iron fences in those Common Area Lots adjacent to the eastern side of Lots 2 & 7, Block 5 and the western side of Lots 2 & 7, Block 5. The wrought iron fences shall be owned and maintained by the Association. Lots 2 & 7, Block 5 are restricted from having any type of fence on the eastern side of the Lot any closer to the eastern boundary of the Lot than the foundation of the residence. Lots 2 & 7, Block 6 are restricted from having any type of fence on the western side of the Lot any closer to the western boundary of the Lot than the foundation of the residence. The intent of this restriction is that no fence will be close to the wrought iron fence. The Grantor and Association shall have an easement over and across these Lots for the purposes of removing any fence that violates this paragraph.

Subdivision Perimeter Fences
4.10.1 Perimeter Fences. After Grantor has transferred title to any Lot which contains a portion of this perimeter fence, it shall be the responsibility of the Owner of that Lot to maintain, repair and/or replace as needed that portion of perimeter fence on the Owner’s Lot. The maintenance, repairs and/or replacement shall be performed so as to keep the perimeter fencing uniform, attractive and harmonious. The Association may, in its sole discretion, maintain some or all of the perimeter fencing as a Common Area expense.

Exterior Maintenance: Owner’s Obligations
4.15 All improvements, especially the exterior appearance of the home, lawn, trees, fencing and landscaping shall be kept in good condition and repair. In the event an Owner permits an improvement to fall into disrepair, or to create a dangerous, unsafe, hazardous, unsightly or unattractive condition, then the Board or Grantor, after 30 days prior to written notice to the offending Owner, shall have the right to enter upon that Owner’s property to correct such condition. Owner shall be obligated to reimburse Board or Grantor for all the costs of the corrective action as set out in Article 8 & 9.

Trash to be Containerized
Trash is to be kept in containers, and those containers must not be visible to other property at all times excluding the weekly pick up time (4.16).

Chronic Dog Barking
Chronic dog barking is considered a nuisance and is not allowed (4.19). It is up to the owner to remedy the situation immediately. Be respectful of your neighbors.

Commercial Vehicles
Commercial vehicles and trailers parked in driveways and streets (4.16, 4.17). They may be removed at owner’s cost (4.18).

Property Appearance
Property appearance of the home, lawn, trees, fencing and landscaping shall be kept in good condition and repair (4.15). No unsightly articles are allowed (4.16).

Architectural Control
Architectural control approvals (4.2). You are required to submit, in writing, any plans that alter your front landscaping, home color, fences, and other structures. You may be required to undo or remove all unapproved changes.

Water drainage
Water drainage onto adjoining lots (4.23). You are responsible for the water originating from your property. You may be liable for damages that your runoff water causes to other property.
